There has been various definition provided for the mobbing process which alienates the employee and can even drive them to suicide in different studies. According to Heinz Leymann who defined the mobbing in workplace comprehensively, the concept means all the hostile and immoral actions that one or more employees systematically carry out, usually towards a single employee. The individual is condemned to despair because of such systematically sustained and difficult-to-get rid of behaviors.
According to the definition in “Psychological Harassment (Mobbing) in Workplaces, Information Guide” prepared by the Ministry of Labor and Social Security, mobbing is “any set of malicious, intentional, negative attitudes, behaviors, and action against another person or persons by one or more persons in the workplace, continuing systematically for a certain period of time, aiming to intimidate, pacify or distance from work; harms the personal values, professional status, social relations or health of the victim or victims.”
Law on Human Rights and Equality Institution of Türkiye defined the term “mobbing” in the literature as “mobbing in workplace.” According to this, mobbing which is accepted as a type of discrimination is described as deliberate actions intended for alienating, excluding and putting-off a person from his/her job on grounds of discrimination cited in the Law no. 6701. According to the Law, in order for actions to be considered as mobbing in the workplace, the actions in question must be carried out with the intention of alienating, excluding, or pester the person out of their job, based on at least one of the grounds listed in the aforementioned Law, and there must be an intention to intimidate (Human Rights and Equality Institution of Türkiye, decision dated 05.05.2020 and numbered 2020/124, para. 19).
